Court of Appeal update in GDPR immigration exemption

Following the decision by the Court of Appeal in May, which ruled that the immigration exemption in paragraph 4 of Schedule 2 to the Data Protection Act 2018 was unlawful and did not comply with Article 23(2) of the GDPR—In a hearing on the 8th October, the Court of Appeal confirmed the immigration exemption to be unlawful. However, the declaration is suspended until 31st January 2022, allowing the government time to amend the legislation.
