High Court awards £250 for DPA breach at "lowest end of spectrum"

A recent case has provided much-needed case law concerning the amounts courts award claimants who suffer a data breach. The judgement came Driver v Crown Prosecution Service [2022] EWHC 2500 (KB), in which Mr Driver took issue with the CPS following an email naming him in a charging file referred to the CPS for consideration. The claim fell within the law enforcement provisions of the Data Protection Act 2018 (DPA) rather than the General Data Protection Regulation (GDPR). The judgment addressed several interesting issues, but the most relevant point was that the award of £250 was at the "lowest end of spectrum" for a data breach.
