New EU Standard Contractual Clauses go into effect

The European Commission published its modernised standard contractual clauses under the EU GDPR in June last year. The new SCCs replace three sets of SCCs that were adopted under the EU Data Protection Directive 95/46/EC. Commencing Monday, the 27th of September, all new data transfer agreements need to use the new SCCs. Organisations have until the 27th of December next year to migrate existing SCC arrangements onto the new SCCs. In a blog post earlier this month, law firm Orrick shared seven things to know about the new SCCs. Bird & Bird have also released a web-based "SCC-generator" tool to assist organisations with tailoring new SCCs.
