High Court dismisses representative claim against Google DeepMind
Google is returning to the High Court in London on Tuesday to contest an appeal of a previous ruling that resulted in the dismissal of a privacy class action lawsuit against it. The lawsuit initiated two years ago by law firm Mishcon de Reya concerns Google's AI subsidiary, DeepMind, for its part in the NHS data scandal involving London's Royal Free Hospital. The legal action arose following an agreement between DeepMind and Royal Free Hospital, whereby the hospital provided 1.6 million historical medical records in exchange for discounted access to a DeepMind-developed app aimed at preventing deaths from acute kidney injuries.
In 2017, the Information Commissioner's Office (ICO) determined that the Royal Free breached the UK Data Protection Act 1998 by sharing patient data without consent. The appeal is now set for hearing in the Court of Appeal as the claimants aim to overturn this previous decision.
