CJEU rules on conditions over the right to rectification

The Court of Justice of the European Union (CJEU) has issued a ruling in Case C-247/23 regarding the right to rectification concerning a person's gender identity. The case involved a person who attempted to change their gender in a Hungarian asylum register. The authorities at the time denied their request due to the absence of documentation confirming sex reassignment surgery. In delivering its judgement, the CJEU clarified that while individuals must provide relevant evidence to prove data inaccuracy, Member States cannot require proof of gender reassignment surgery as a condition for the right to rectification.
