The French data protection authority, the CNIL, announced that its €35m fine against Amazon for breaching Article 82 of the French Data Protection Act over its use of advertising cookies can proceed. The Council of State, Conseil d'État confirmed that CNIL can impose sanctions outside of the so-called One-Stop-Shop (OSS) mechanism. The court upheld the French DPAs competence and ability to enforce on the matter and confirmed Amazon's violations, dating back to December 2020, were related to applying cookies without consent and not informing users of the application.
