CMA responds to government data protection consultation

The Competition & Markets Authority has responded to the DCMS proposals to overhaul the UK's data protection framework in its consultation Data: a new direction. The CMA "welcomes the key aim of the government's data strategy to support vibrant competition and innovation to drive economic growth. Data, including personal data, is an increasingly important component of modern digital economies and is a key enabler of increased competition." The CMA highlights tensions between privacy and competition and urges the government to mitigate these in its approach to data protection, particularly where privacy is "inappropriately used as a mask for anti-competitive behaviour." While the CMA welcomes the intention to enable greater access to data, they also warn against taking away individuals data rights as this would harm public confidence and trust.
