When is health data anonymous?

An op-ed in Digital Health looks at the complex issue of when health data is anonymous. The article welcomes the ICO's draft anonymisation, pseudonymisation and privacy-enhancing technologies guidance consultation. In particular, the draft guidance elaborates on the concept of "effectively anonymised", where pseudonymous information can be anonymous, providing that the holder of the data does not know the identity of the pseudonyms and that appropriate controls are in place to prevent identification. The writers argue this could appeal to researchers as it will circumnavigate requirements of the UK GDPR as it will no longer categorise the data as personal. It also means data can simultaneously be both personal and anonymous.
