Dutch DPA fines Clearview AI €30m

On Tuesday, 3 September 2024, the Dutch data protection authority (AP) announced that it had issued a €30.5 million fine to Clearview AI Inc. for multiple violations of the EU General Data Protection Regulation (GDPR).

Following an investigation, the AP found that Clearview AI had built an illegal database with insufficient transparency. 

The AP cited violations of: 

  • Articles 5(1)(a) and 6(1) of the GDPR for processing the personal data of data subjects without a legal basis; 
  • Article 9(1) of the GDPR for the processing of a special category of personal data; 
  • Articles 12(1), 14(1), and 14(2) of the GDPR for failing to adequately inform data subjects concerning the use of their photo and biometric data; 
  • Article 27(1) of the GDPR for failing to designate an EU representative; 
  • Articles 12(2), 12(3) and 15 of the GDPR for subject access violations.
