The European Data Protection Board (EDPB) has published its opinion on the draft adequacy decision concerning the proposed EU-US Data Privacy Framework. While the board welcomes improvements around areas involving the introduction of necessity and proportionality requirements for US intelligence gathering and a new redress mechanism for EU data subjects, the EDPB identified several areas of concern that require further clarification. EDPB Chair Andrea Jelinek said, "after the first review of the adequacy decision, subsequent reviews should take place at least every three years and we are committed to contributing to them."
The IAPP and Hogan Lovells provide further analysis of the "bumpy road towards a new adequacy decision."
