EDPB adopts right of access guide and cookie consent response

20/01/2022 | EDPB

During its January plenary session, the European Data Protection Board adopted guidelines on the right of access under the EU General Data Protection Regulation, along with a response to queries regarding consistent interpretation of cookie consent across member states. EDPB Chair Andrea Jelinek said the guidelines will "provide examples to support controllers to answer access requests in a GDPR compliant manner." In its letter on cookie consent, the EDPB noted a commitment to "ensuring the harmonised application" of rules on cookie consent while pointing to the board's cookie taskforce and updated consent guidelines.

The EDPB published the agenda for its January plenary session earlier in the week.  The board planned to discuss the adoption of guidelines around the right of access under the GDPR and draw up its response to various letters calling for a consistent interpretation of cookie consent requirements across the EU. Additionally, the EDPB will respond to a questionnaire evaluating the EU Law Enforcement Directive.
