GDPR enforcement challenges weigh on international data transfers

In an op-ed for EU Law Live to mark the 5th anniversary of the EU General Data Protection Regulation (GDPR), Christopher Kuner examined how the EU's approach to international data transfers "remains a work in progress". In a balanced account, Kunar lists a number of GDPR-related challenges ranging from institutional tensions, the trend to implement complex formalised transfer mechanisms, and problems with cross-border enforcement. While Kumar also points out the GDPR's many successes, he explains that the EU should include proposals to address these challenges in its 2024 GDPR evaluation report.
