European Commission publishes Data Act FAQs and Explainer

On Friday, 6 September 2024, the European Commission published a frequently asked questions (FAQs) and an explainer document on the Data Act, which enters into force on 12 September 2025. The FAQs provide insights into how the Data Act interacts with other EU legislation, such as the General Data Protection Regulation (GDPR) and the Data Governance Act (DGA). As such, the FAQs offer guidance on data access, data sharing, and data use within the EU. In addition, the FAQs outline the implications that the Data Act will have on the Internet of Things (IoT), including providing clarity on the types of IoT data covered. The FAQs also offer stakeholders comprehensive information about how trade secrets and data access rights are dealt with under the Act.
