European Commission publishes Digital Fairness Fitness Check

On Thursday, 3 October 2024, the European Commission published its Digital Fairness Fitness Check, examining the adequacy of current EU consumer protection laws in the digital environment. The findings indicated the ongoing relevance and necessity of such regulations. However, the report also highlighted the disparity in consumer behaviour online versus offline, underscoring the need for more tailored regulations to address specific harmful practices, including the use of dark patterns in online interfaces, addictive design of digital services, personalised online advertising targeting, the ability to manage digital subscriptions, and problematic issues involving the commercial practices of social media influencers.
