IAB Europe submits Position Paper on Consent or Pay models to EDPB

IAB Europe and its partners have submitted a position paper responding to the European Data Protection Board's (EDPB) Opinion on the legality of Meta's tiered "Consent or Pay" subscription model and its anticipated draft Guidelines. IAB Europe's concerns include increasing legal uncertainty for businesses of all sizes, not only "large online platforms", and undermining the sustainability of some digital services, which users can access for free. Furthermore, IAB Europe claims that the EDPB is relying on an " expansive and unprecedented interpretation of data protection law and based on a fundamentally flawed understanding of the digital advertising industry."
