If the draft American Data Privacy and Protection Act is passed, it would be the first comprehensive federal law requiring data protection and security that will affect most organisations. While much of the focus for the draft federal bill has been on preemption, redress mechanisms, and the enforcement role of the US Federal Trade Commission, the cybersecurity and data security provisions should not be overlooked. The requirements include data security policies and administrative, technical and physical practices.
