Court rejects appeal over GDPR monetary penalty notice

The Information Commissioner's Office (ICO) has welcomed a ruling by the Court of Appeal (CoA) dismissing an appeal against a historic UK General Data Protection Regulation (GDPR) monetary penalty notice of £275,000 issued to Doorstep Dispensaree Limited (DDL) in December 2019. 

The CoA dismissed both grounds for appeal, ruling that the burden of proof in an appeal lies with the appellant and that subsequent tribunals and appeals are not required to ignore the original monetary penalty notice when making their decisions.

In a statement, Information Commissioner John Edwards said:

"I welcome the Court of Appeal's judgment in this case as it provides clarity for future appeals. We defended our position robustly and are pleased that the Court has agreed with our findings."
