ICO approves private investigators' code of conduct

The Information Commissioner's Office (ICO) has approved the first sector-specific code of conduct for private investigators under Article 40 of the UK General Data Protection Regulation (GDPR).

Private investigators can voluntarily sign up for the code, which aims to provide clarity and assurance to clients regarding GDPR compliance. The code addresses common data protection challenges experienced by individuals and companies operating in the private investigations sector, including:

  • The roles of investigators as controllers or processors 
  • How to conduct Data Protection Impact Assessments

The code also helps members identify the lawful bases for various forms of data processing, such as:

  • Covert surveillance 
  • Tracking devices 
  • Background checks 
  • Social media monitoring

In addition, the code includes practical examples of lawful tracing and locating of individuals.
