ICO issues practice recommendation to United Utilities for EIR failings

The Information Commissioner's Office (ICO) has issued a practice recommendation to United Utilities (UU) for failing to meet its obligations under the Environmental Information Regulations (EIR).

Following an investigation, the ICO found that UU had repeatedly failed to respond to information requests within the legal timeframe of 20 working days. Furthermore, the ICO uncovered that the water utility company had rejected other EIR requests because they were outside the scope of the regulations. The ICO has since told UU to broaden its interpretation of environmental information and ensure proper handling of legitimate EIR requests. The practice recommendation also includes steps for the company to improve compliance, such as proactively publishing frequently requested information and providing staff training for appropriate request handling.
