ICO renews application to appeal Clearview AI ruling after 11 months

On Monday, 28 October 2024, the Information Commissioner's Office (ICO) provided an update following the First Tier Tribunal's decision in November 2023 to uphold an appeal by Clearview AI and overturn the £7.5 million monetary penalty and enforcement notice issued by the ICO in May 2022.

In the latest update, the ICO explained that it has renewed its application for permission to appeal the FTT judgment to the Upper Tribunal. While there is no explanation for the 11-month delay, the ICO clarified that the latest application comes after the regulator received notification that the FTT refused its application filed in November.

In a blog article, data protection specialist Jon Baines discussed the 11-month delayed announcement and the precise wording, which suggests that the delay relates to an issue with the FTT and not with the ICO.
