ICO responds to CMA digital markets competition guidance consultation

The Information Commissioner's Office (ICO) has submitted a response to the Competition and Markets Authority's (CMA) consultation on new digital markets competition guidance.

In its response, the ICO has expressed its support for the Digital Markets, Competition and Consumers Act (DMCC) and the new pro-competition regime. The ICO believes that this regime has the potential to improve consumer outcomes in digital markets by providing more transparency, increasing consumers' data protection rights, and protecting them from potential harm related to the misuse of personal data.

The ICO also sees an opportunity to enhance privacy and competition outcomes for consumers by leveraging synergies between competition and data protection regulatory regimes. However, in certain situations, the ICO recognises the possibility of tensions arising between competition and data protection interests and underscores the importance of effective cooperation between the ICO and CMA to mitigate any potential issues.
