Following the hundreds of complaints filed by NOYB against companies using questionable cookie consent banners (here, here and here), the European Data Protection Board (EDPB) established a cookie banner taskforce in September 2021. On Thursday, 11 July 2024, NOYB published a consent banner report of its own, comparing the EDPB taskforce's findings for each consent banner violation with the stances taken by national data protection authorities (DPAs) in guidance documents and decisions. NOYB expects that its report will serve as a valuable resource for companies configuring consent banners and hopes to stimulate further dialogue on deceptive practices' guidelines and their future development to ensure users are offered a fair and unrestricted choice in consent banners.
The report explores different practices, outlining pertinent issues, the EDPB taskforce's position, and the guidelines published by national DPAs. It also includes information on actual DPA decisions wherever available.
