The Court of Justice of the European Union (CJEU) Advocate General (AG) Tamara Capeta has issued a non-binding Opinion in Case C‑97/23 P between WhatsApp and the European Data Protection Board (EDPB) concerning the company's right to appeal a €225 million fine issued by the Irish Data Protection Commission (DPC) in September 2021 to a national court.
In issuing the Opinion, Capeta sided with WhatsApp, stating that its "challenge of the EDPB decision is admissible and the case should be referred back to the General Court for a decision on the merit."
