Italian DPA warns TikTok legitimate interest is inadequate for targeted ads

The Italian data protection authority, the Garante, has issued a warning to TikTok after it announced its intention to deliver targeted advertising to users age 18 and over using legitimate interest as its legal basis for processing, rather than informed consent. Following a review, the Garante found TikTok's updated privacy notice and further information the company provided violated the EU ePrivacy Directive and ordered immediate steps to come into compliance.

UPDATE: 120722 - TechCrunch reports TikTok has paused plans to update its privacy policy in Europe following engagement with the Irish Data Protection Commission (DPC). A DPC spokesperson said: "TikTok has now agreed to pause the application of the changes to allow for the DPC to carry out its analysis."
