On Tuesday, 26 November 2024, Meta continued its fight to overturn the €225 million fine issued to WhatsApp by the Irish Data Protection Commission (DPC) in September 2021 for EU General Data Protection Regulation (GDPR) transparency violations over its data-sharing plans with Facebook and Instagram.
In its latest legal challenge (Case C-97/23 P) to the General Court of the EU Court of Justice, Meta argued that it should be able to challenge the binding decision issued by the European Data Protection Board (EDPB), increasing the DPC's proposed €50 million fine to €225 million.
The General Court had previously denied a challenge by Meta in December 2022 on the grounds that the EDPB's decision did not directly affect the company as it was directed at the DPC.
A decision is expected next year.
