UPDATE: EU-US data transfer talks progressing

17/09/2021 | Reuters

Discussions regarding a potential replacement for the EU-US Privacy Shield have ramped up. People familiar with negotiations said EU and US officials are making progress on their data transfer dilemma ahead of an upcoming meeting between the two sides at the end of September. A key talking point is providing Europeans with a mechanism to challenge potential US government surveillance.  In related news, Politico reports that the French National Cybersecurity Agency Director-General has called for US authorities to stop accessing data stored in Europe by US cloud companies. Europe needs “a rule that only European law is applicable on cloud products certified in Europe” for services like health care and finance. “This is not about turning our backs on partners. But it’s about having the courage to say that we don’t want non-European law to apply to these services.”

UPDATE: 170921 - Politico informs on the conflicting reports coming from EU and US regulators over a replacement data transfer agreement. Officials from the US claim a deal is very close, whereas their EU counterparts view an agreement still some way off. According to reports, the US has proposed “enhanced” solutions to overcome the impasse and a political agreement could be announced within a couple of weeks to coincide with the first EU-U.S. Trade and Technology Council meeting on 29th of September.
